Terms of Use

1. Introductory provisions

These Terms of Use ("Terms") govern access to and use of the website and the Android mobile app (the "Service") operated by Tobias Heneman (the "Operator"). The Service is a non-commercial project and is not operated for the purpose of doing business.

By using the Service you agree to these Terms. Creating a user account is conditional on your agreement to these Terms and to the Privacy Policy, which you expressly confirm during registration. The Operator records the moment at which you gave your agreement.

2. Description of the Service

The Service is an educational information website complemented by artificial intelligence features (AI chat, text generation), user accounts and an Android mobile app. The Service is provided free of charge.

3. User account

• Some features of the Service require registration. You can create an account with an e-mail address and password or by signing in with Google.
• When registering you provide truthful information and are responsible for keeping your password secret. You are responsible for all activity under your account.
• Age: the Service is also intended for primary school pupils. If you are under 15, you may create an account only with the consent of a parent or other legal guardian (Section 7 of Czech Act No. 110ㅤ/2019 Coll.).
• Deletion by the user: you can delete your account yourself at any time in your profile using the "Smazat můj účet" (Delete my account) button. Deleting the account removes the related data, including credits, and it cannot be restored.
• Suspension or deletion by the Operator: the Operator may suspend or delete an account if the user breaches these Terms or abuses the Service, or for another serious reason.

4. Credits

• To use AI features, the Service uses credits. A new account receives initial credits; further credits can be earned, for example, through a daily bonus or as a reward for using the mobile app. Each use of an AI feature consumes credits.
• Credits have no monetary value and cannot be paid out, exchanged for money or transferred to another account. They are not a means of payment or a security.
• The Operator may change the amount of initial credits, the daily bonus and the credit cost of individual features at any time.
• Credits do not expire. They are used up as you use AI features.
• When an account is deleted or terminated, credits are forfeited without compensation.
• Credits cannot be purchased. They are obtained only in the ways described above, and the Service remains free.

5. Rules of use

The user undertakes:

• not to use the Service for unlawful purposes or to harm third parties,
• not to enter personal data of third parties into AI features without their consent,
• not to abuse or disrupt the Service or attempt unauthorised access to it,
• not to try to circumvent the Service's restrictions, in particular the usage limits for AI features and the credit system (for example, by creating multiple accounts, changing the device identifier or sending automated requests),
• to respect the intellectual property of the Operator and third parties.

6. Use of artificial intelligence (OpenAI)

The Service uses technology from OpenAI, LLC (GPT-4o model) for artificial intelligence features. Inputs entered by the user, including the content of posts attached to a conversation, are sent to OpenAI servers for processing. The user acknowledges that:

• Personal data, especially sensitive data, should not be entered into AI features.
• Outputs generated by AI are automated and may be inaccurate, incomplete or incorrect. They are not a substitute for a teacher or a textbook, and you should not rely on them as your only source, in particular when preparing graded work.
• The Operator is not responsible for content generated by AI.
• The Operator may modify, restrict or disable AI features or any part of them.
• OpenAI's processing of data is governed by the OpenAI privacy policy.

7. User content

You own the notes, AI chat messages, feedback and other content that you enter into the Service. You grant the Operator a non-exclusive, royalty-free permission to store and process this content to the extent necessary to run the Service (for example, saving notes, displaying chat history, handling feedback). We do not use user content for any other purpose and do not publish it. The Operator may remove content that breaches these Terms or the law.

8. Intellectual property

All content of the Service (texts, graphics, code) is protected by the Operator's copyright unless stated otherwise. The Service also includes open-source libraries (for example KaTeX and Lucide), which are governed by their own licences. AI-generated content is provided "as is" without any guarantee of originality.

9. Limitation of liability

The Service is provided "as is" without any guarantee of availability or accuracy of content. To the extent permitted by law, the Operator is not liable for:

• damage arising from the use of, or inability to use, the Service,
• inaccuracies in content generated by artificial intelligence,
• third-party content to which the Service links.

This provision does not affect liability that cannot be excluded or limited under the law, in particular liability for harm caused intentionally or through gross negligence and for harm to life and health.

10. Mobile app (Android)

The Android mobile app can be downloaded at Android Aplikace. By downloading and using the app you agree to these Terms. The app contains no cookies and no analytics or telemetry tools; to send notifications we store a device token and the device name (details are in the Privacy Policy).

11. Personal data protection

We process personal data in accordance with the Privacy Policy, which forms an integral part of these Terms.

12. Changes to the Terms

The Operator reserves the right to change these Terms. We will publish the updated version on the website, stating the date from which it applies. We inform registered users of material changes by a notice in the Service. If you do not agree with the new Terms, you can stop using the Service and delete your account. By continuing to use the Service after the effective date of a change, you express your agreement with the new wording.

13. Governing law

These Terms are governed by the law of the Czech Republic. Any disputes will be resolved by the competent courts of the Czech Republic. This does not affect consumer rights under the law.
